Common mistakes while filing a workers’ compensation claim

If you believe one of the many myths surrounding Pennsylvania workers’ compensation, those misconceptions can cost you. Some employers or their insurance companies misunderstand their own plans, or intentionally try to mislead their employees to intimidate them and prevent them from filing a claim.

If you or a loved one needs to file a workers’ compensation claim, don’t fall prey to these common mistakes.

  1. Failing to file a report properly. It is not required that you file a report within 24 hours of the accident, but in Pennsylvania you may have 21-120 days. Be sure your report is accurate, signed, and filed before your deadline.
  2. Not appealing if you are denied. If your claim is denied, or you miss the deadline, you have a chance to appeal. Their “no” is not the end. A legal representative can give advice or fight for you against the employer’s insurance company.
  3. Failing to follow medical advice. Your employer’s insurance company can use your mistake or neglect as grounds to deny your claim. Be sure to ask the doctor any questions you have about your medical treatment but avoid talking directly about your case.
  4. Returning to work early or late. It will hurt your case if you return to work too soon. Rather than displaying loyalty, it demonstrates you are feeling better, or intentionally putting yourself at risk. Returning late could seem needy or lazy.
  5. Accepting workplace discrimination when you return. If you are unable to perform your previous duties, you should know exactly what you will be doing when you return and for how long. If they change your salary, make jokes, or fire you, this could be grounds for workplace discrimination.
  6. Discussing your case with uninvolved parties. Avoid discussing your case on social media or with anyone uninvolved in your case.
